This Contractor Agreement ("Agreement") governs the relationship between you, an independent service professional ("Contractor"), and HandyMandyMan, Inc. ("HMM") regarding your use of the Platform.
1. Independent Contractor Relationship
You acknowledge that you are an independent contractor — not an employee, partner, agent, or joint venturer of HMM. You control the manner and means by which you perform services.
2. Eligibility & Verification
- You must hold all licenses, permits, and insurance required by applicable law.
- You consent to background checks and license verification.
- You agree to maintain accurate, current information on your profile at all times.
3. Platform Fee
HMM retains a 15% platform service fee on the gross amount of every completed booking. This fee is non-refundable, including in the event of customer cancellation after payment authorization.
4. Payments via Stripe Connect
You must onboard a Stripe Connect account to receive payouts. Customer funds are held in escrow by Stripe and released to your Stripe balance after both parties confirm completion. Stripe processing fees apply per Stripe's published rates.
5. Service Standards
- Perform all work in a professional, timely, workmanlike manner.
- Comply with all applicable building codes, safety regulations, and laws.
- Carry general liability insurance with at least $1,000,000 coverage.
6. Indemnification
You agree to indemnify, defend, and hold harmless HMM from any claims, damages, or liabilities arising from your services, your acts or omissions, or your violation of this Agreement.
7. Taxes
You are solely responsible for all federal, state, and local taxes on your earnings. HMM will issue a 1099-K via Stripe where required.
8. Suspension & Termination
HMM may suspend or terminate your account for violation of this Agreement, repeated negative reviews, fraudulent activity, or any conduct deemed harmful to the Platform community.
9. Non-Solicitation
For 12 months after first contact through the Platform, you agree not to solicit Customers off-Platform for services within scope of HMM's marketplace.
10. Arbitration
Disputes shall be resolved exclusively by individual binding arbitration. Class actions are waived.
